GENERAL CONDITIONS OF CONTRACT
1. Scope of the contract - These General Conditions of Contract apply to the sale of all the products of Ana Lobato Jiménez, with NIF025663580L, (hereinafter RADIO-ANTIGUA) by phone, email or through her virtual store, located on the website www.radio-antigua.com, to professionals, COMPANIES, consumers, users or any other final recipient (THE USER), to whom orders can be delivered within the Spanish territory and outside it in accordance with the provisions of clause 6. The use by the USER of the services of the RADIO-ANTIGUA store presupposes, in any case, adherence to the General Conditions of Contract in the version published by RADIO-ANTIGUA at the very moment of sending the order request, which is available to customers on the website. Therefore, it is advisable for THE USER to read the General Conditions carefully before proceeding to make an order request. Thus, if THE USER through the website, in the shopping cart, chooses the option "I have read and accept the Terms and Conditions", the USER will be considered to fully understand and accept them. On the other hand, if THE USER does not accept these General Conditions of Contract, he will conclude the operation and will not entail the assumption of any type of obligation on the part of the USER. Once an order request has been made through the website, the USER will receive an email confirming that the Order request has been sent correctly. Along with the confirmation of receipt of the Order Request, a copy of these General Conditions of Contract and the Withdrawal and Revocation Document will be delivered.
2. Prices, method of payment, deliveries, availability and returns of products
2.1. Prices - The prices indicated on the screen next to each PRODUCT will be expressed in Euros and will include VAT (Value Added Tax) or will not include it as indicated. The amount to be paid includes the corresponding VAT in the shopping cart, along with the shipping costs, which may be applicable. On occasion, surcharges may apply for order management. These surcharges will appear in the shopping cart before the USER finalizes the order request and with an explanatory note. If it is not specified otherwise, the products that are subject to a fee according to Article 25.21 of Royal Legislative Decree 1/1996 of April 12, which approves the Consolidated Text of the Intellectual Property Law, incorporate the fee in the sale price. Tenders will be duly marked and identified as such. RADIO-ANTIGUA reserves the right to make, at any time and WITHOUT prior notice, the modifications it deems appropriate, being able to update products and prices daily depending on the market. The price applicable to the order request made by the USER will be the one recorded at the time of accepting the General Conditions of Contract. Once the order is confirmed, RADIO-ANTIGUA reserves the right to notify the USER of any price error present in the order, with the USER having the power to cancel his order request if the final price is very different from the one initially indicated, refunding, where appropriate, the amount paid and offering him alternative possibilities that satisfy the customer. The prices of international sales will be governed by the provisions of clause 6.
2.2. Payment method - All purchases arising from the acceptance by RADIO-ANTIGUA of an Order Request can be paid by bank transfer in any of the bank accounts provided by RADIO-ANTIGUA. The user, if he wishes, can use Paypal or Google Check-out to make the payment. In this case, the USER accepts that Paypal or Google Check-out will charge their card or BANK ACCOUNT in advance the amount indicated in the Shopping Cart. For security reasons, in case the personal data provided on RADIO-ANTIGUA.com is different from the data that appears in the Paypal or Google Check-out account used for the payment, RADIO-ANTIGUA reserves the right not to accept the payment being able to cancel the Order Request, if he has doubts that the buyer is not the owner of the Paypal account or Google Check-out used. The USER can cancel any ORDER REQUEST before definitively confirming their PURCHASE ORDER. If the ORDER has already been confirmed, via e-mail or by any other means of communication, it must comply with the provisions of section 2.4 of these General Conditions of Contract.
2.3. Deliveries and Availability - Once the payment of the order has been verified, in case the ordered items are available, the orders will leave from the warehouse of RADIO-ANTIGUA or its suppliers to the delivery address indicated by the USER, within approximately 2 working days. If the USER does not receive the ORDER within approximately 4 days for the Iberian Peninsula, 2 weeks for the Balearic Islands, Canary Islands, Ceuta and Melilla from the date of departure from the warehouse, he can contact RADIO-ANTIGUA through the email info@radio-antigua.com. RADIO-ANTIGUA will do everything possible to meet the indicated delivery deadline and if it becomes aware that for any reason it will not be possible to comply, it will communicate it via e-mail or phone to the USER. Shipments will mostly be made through the CORREOS services of Spain. In the event that the USER requires a fast delivery service, and in the event that it is possible to use that type of service, RADIO-ANTIGUA will inform the USER of the corresponding cost and pass it on to the USER. Some items can only be shipped to the peninsula (Spanish territory) and the Balearic Islands. In case of receiving an Order request from an area where it is impossible to send the requested items, RADIO-ANTIGUA will notify the USER as soon as possible. In certain circumstances, if the demand for an item is very high, a product may not be available at the time of placing the order request. The customer service staff of RADIO-ANTIGUA will inform the USER of the non-availability of the product, as soon as they become aware of it, of the impossibility of supplying the item requested by the USER. The USER may decide whether to cancel the request for the order or, if necessary, request the quote of an alternative product of similar characteristics.
RADIO-ANTIGUA is not responsible for possible stock shortages that may be generated by the demand for the products.
2.4. Return and withdrawal or revocation - THE USER can exercise his right of repentance and return any PRODUCT following the regulations in force in distance selling. Any return, withdrawal or revocation in the execution of the sales contract must be made by sending the Withdrawal or Revocation Document annexed to these General Conditions to RADIO-ANTIGUA. In the event that the withdrawal or revocation was prior to the receipt of the PRODUCT and consequently of the Withdrawal and Revocation Document, the USER will contact RADIO-ANTIGUA to be able to exercise his right to withdraw or resolve the operation. To do this, it is necessary for THE USER to contact Customer Service (info@radio-antigua.com) and detail the reasons for the return. In all cases, provided that the right of repentance is exercised within 7 working days of receipt of the ORDER, RADIO-ANTIGUA will make a payment of the invoice originally issued and will return to the USER the full amount of the purchase and the shipping costs, being borne by the USER the costs of returning the PRODUCT purchased. The return will be effective within 5 days of receipt of the ORDER that is the subject of the return. RADIO-ANTIGUA may terminate the contract before the PRODUCT is delivered to the USER only if it had grounds to believe that the means of payment or the end of the purchase is not lawful or valid. In this case, RADIO-ANTIGUA will contact the USER and clearly propose an alternative to save the irregularity detected.
3. Guarantees - The warranty of the items marketed by RADIO-ANTIGUA is 2 years for private users as provided for by Law 23/2003 of July 10 on Guarantees in the Sale of Consumer Goods. The warranty of some consumables (vacuum valves, etc.) will be limited to 7 days since their useful life depends on the use of them and the conditions of the equipment on which it is installed. The warranty for corporate users will be that established by the policy of each manufacturer. The warranty of second-hand items will be 1 year as provided for by Law 23/2003 of July 10 on Guarantees in the Sale of Consumer Goods. Specifically, when the USER wants to exercise his right to the guarantee, he may choose between the repair or replacement of the property (unless one of these options is impossible or disproportionate), or subsidiarily between a reduction in the price or the termination of the contract, all under the terms and conditions established in the legislation on guarantees of consumer goods and other applicable regulations where appropriate. RADIO-ANTIGUA will be responsible for the lack of conformity of the property during the deadlines and under the conditions established by law. Likewise, the USER is subject to compliance with the requirements and deadlines provided for in the legislation for the exercise of these rights. In addition, article 123.4 of the General Law for the Defense of Consumers and Users establishes that: "The consumer and user must inform the seller of the lack of conformity within two months of becoming aware of it."
4. International Sales - Any customs expense that may accrue from the transport of the products from the country of origin to the country of destination will be borne by the Customer. All the provisions of these General Conditions of Contract will apply to international sales unless any of their stipulations are contrary to the national legislation of the USER's country of origin.
5. Applicable law and jurisdiction - These General Conditions are governed by Spanish law. Both parties submit to the Courts and Tribunals of the city of Malaga waiving their own jurisdiction if this is different; in the case of consumers, the parties submit to the courts and tribunals of the consumer's domicile.

Any return authorized by RADIO-ANTIGUA will mean that the USER follows the instructions received by RADIO-ANTIGUA and manages the delivery to postage PAID or DUE, as indicated, in the place indicated by RADIO-ANTIGUA: The material must have its original packaging. For commercial returns RADIO-ANTIGUA reserves the right to apply a penalty in the event that the product is not in perfect condition. DESPISED PRODUCTS WILL NOT BE ACCEPTED.
3. The unauthorized reproduction, distribution, commercialization or transformation of such works constitutes an infringement of the intellectual property rights of RADIO-ANTIGUA or the owner thereof, and may give rise to the exercise of any judicial or extrajudicial actions that may correspond to them in the exercise of their rights. Likewise, the information that THE USER can access through these web pages may be protected by industrial, intellectual or other property rights. RADIO-ANTIGUA will not be responsible, in any case and under any circumstances, for the infringements of such rights that may be committed by the USER.
